1. Introduction

Welcome to MiracleJar. By using our application ("App") and services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

These Terms govern your access to and use of MiracleJar's applications, website, and services. The Terms constitute a legally binding agreement between you and MiracleJar regarding your use of the service.

2. Description of Service

MiracleJar is an application that allows users to capture and store memories digitally and receive them periodically through digital delivery and, for certain subscription tiers, in physical memory jars.

3. Subscription Terms

MiracleJar offers various subscription plans with different features and delivery options.

3.1 Auto-Renewal

All subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can turn off auto-renewal at any time by going to your Account Settings in the App Store after purchase.

3.2 Billing

Payment will be charged to your Apple ID account at the confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24-hours prior to the end of the current period.

3.3 Subscription Tiers and Benefits

MiracleJar offers the following subscription options:

  • Digital Premium Plan: All memories monthly with optional email delivery

  • Quarterly Plans (Small/Large Jar): Seasonal jar delivery plus all digital premium features

  • Annual Plans (Small/Large Jar): Four seasonal jars per year plus all digital features

3.4 Free Tier

The free tier allows limited access to the service with a set number of randomly selected memories each month.

3.5 Cancellation

You can cancel your subscription at any time through your Apple ID account settings. Cancellations will take effect at the end of the current billing period. No refunds will be provided for partial subscription periods.

4. User Content

4.1 Ownership

You retain all rights to the content you submit, upload, or otherwise provide to MiracleJar ("User Content"). By providing User Content to our service, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, process, adapt, and display such content solely for the purpose of providing the MiracleJar services to you.

4.2 Content Restrictions

You may not submit content that is illegal, infringing, threatening, abusive, defamatory, invasive of privacy, or otherwise objectionable.

5. Privacy Policy

Your privacy is important to us. Our Privacy Policy, available at https://www.miraclejar.org/privacy-policy, explains how we collect, use, and protect your personal information when you use our service.

6. Shipping and Delivery

For physical jar subscriptions:

6.1 Delivery Address

You are responsible for providing and maintaining an accurate shipping address for physical deliveries. Address changes must be submitted at least 7 days before the scheduled delivery date.

6.2 Delivery Timeframes

MiracleJar will make reasonable efforts to deliver physical jars according to the seasonal schedule. Delivery times may vary based on location and shipping conditions.

7. License Grant

MiracleJar grants you a personal, non-transferable, non-exclusive license to use the App on compatible devices that you own or control, subject to these Terms.

8. Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MIRACLEJAR, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICE.

IN NO EVENT WILL MIRACLEJAR'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNT PAID BY YOU TO MIRACLEJAR FOR THE SERVICE OVER THE 12 MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Indemnification

You agree to defend, indemnify, and hold harmless MiracleJar, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the service or your violation of these Terms.

11. Termination

MiracleJar may terminate or suspend your access to the service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the service will immediately cease.

12. Modifications to the Service and Terms

MiracleJar reserves the right to modify or discontinue, temporarily or permanently, the service with or without notice. MiracleJar also reserves the right to update or revise these Terms at any time by posting the updated Terms on the website. Your continued use of the service after any such changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and MiracleJar regarding the use of the service, superseding any prior agreements between you and MiracleJar.
